1 · The short version

PostureVision is a wellness tool that uses your camera to measure posture, stability, focus, and presence — and gives you scores, cues, and trends so you can build healthier habits. These Terms are the agreement between you and PostureVision, Inc.

We wrote them in plain English on purpose. They cover subscriptions, what you can and can't do with the service, the fact that we're a wellness tool (not a medical device), and the honest limits of what either of us is responsible for. If something goes sideways, we'd always rather hear about it than argue about it.

A two-way agreement

You get a thoughtful tool built with care. We get clear ground rules so we can keep building it for everyone who uses it.

2 · Acceptance of terms

You accept these Terms when you create an account, tap "I accept" on the policy screen, or continue using PostureVision after they take effect. If you don't accept them, please don't use the service.

Age requirement. You must be at least 13 years old to use PostureVision. If you're between 13 and 17, a parent or legal guardian must review these Terms and our Privacy Policy and accept them on your behalf.

Authority. If you're accepting these Terms on behalf of an organization (a clinic, employer, or team), you're confirming that you have the authority to bind that organization to this agreement.

3 · The service

PostureVision provides software that analyzes live camera frames to measure posture and related wellness signals, along with dashboards, reminders, coaching cues, and educational content. You can use it on iOS, Android, the web, and (soon) desktop.

PostureVision is a wellness tool, not medical advice. Our scores and cues are designed to build awareness and support healthy habits. They are not a diagnosis, a treatment plan, or a substitute for care from a licensed clinician. See §10 for the full disclaimer.

Availability. We work hard to keep the service running, but we don't guarantee 100% uptime. The service may be unavailable during maintenance, updates, outages at our providers, or events outside our reasonable control.

Modifications. We may add, change, or remove features over time. If we materially reduce a feature you rely on during a paid period, we'll give you reasonable notice and, where appropriate, a prorated refund.

4 · Your account

Your account is yours alone — and we mean that for a specific reason.

PostureVision becomes incredibly personalized over time. Your baseline, your movement patterns, your Poise trend, your self-corrections — all of it is built from your body, moving in your spaces, on your days. That personalization is what makes the tool work. It also means your account can't meaningfully be shared: suggestions calibrated for you will be actively wrong for someone else.

To protect the experience, we periodically re-match your likeness during sessions to confirm it's still you on camera. This isn't surveillance — we're not storing the frames. We're just making sure the scores we're giving belong to the person who's earned them.

Share PostureVision, not your account. Your family and friends are welcome to create their own free accounts to try it out. That's how they'll get something that fits them — and honestly, it's the most generous thing you can do with the product. Tell them about it. Bring them in.

5 · Subscription and payments

Free trial. We may offer a free trial period. At the end of the trial, your subscription automatically converts to a paid plan unless you cancel before the trial ends.

Auto-renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual, depending on your plan) at the then-current price, using the payment method on file, until you cancel.

Heads up · Auto-renewal

Your subscription renews on its own. You can cancel any time in Settings → Subscription, or through the App Store / Play Store if that's where you signed up. Cancel before the renewal date to avoid the next charge.

Cancellation. You can cancel at any time. When you cancel, your subscription stays active through the end of the current billing period, and you won't be charged again.

Price changes. If we change subscription prices, we'll email you at least 30 days before the change takes effect. If you don't agree, you can cancel before the new price kicks in.

Refunds. We offer a good-faith refund window of 7 days from your first paid charge — if PostureVision isn't working for you, email hello@posture.vision and we'll make it right. After the 7-day window, subscriptions are generally non-refundable, though we review edge cases in good faith (e.g., a billing error or an extended outage).

Failed payments. If a payment fails, we'll retry a few times over a short grace period and email you. If payment still doesn't go through, we may downgrade your account to a limited free tier until the balance is resolved.

App Store / Play Store purchases. If you subscribed through Apple or Google, their billing terms and refund policies also apply — including the way you cancel.

6 · Acceptable use

PostureVision was built on the shoulders of decades of clinical research, years of engineering craft, and a scoring system that took hundreds of hours of iterative tuning alongside practitioners who know this work. That body of knowledge — the code, the models, the scoring, the thinking behind it — is the intellectual property of PostureVision, Inc. We respect what we've made, and we ask you to as well.

Most people will never come anywhere near the line below. These rules exist for the rare exception — not for you.

Please don't:

Attempts to copy, clone, or steal PostureVision's intellectual property — whether by scraping models, reverse engineering, reproducing our scoring system in a competing product, or any similar pathway — are met with direct legal action. We'd rather spend our time building with you than protecting against this, but we will protect it. Kindly, firmly, completely.

If you spot a security issue, please report it to security@posture.vision. Responsible disclosure is always welcome, and we respond quickly.

7 · Your content and data

Your data is yours. That includes your session measurements, your intake answers, any notes you log, and any silhouettes stored if you opt into session replay.

To actually deliver the service, you grant us a limited, worldwide, royalty-free license to host, process, and display your data for the purpose of providing, maintaining, and improving PostureVision. This license ends when you delete your data or close your account — except for anonymized, aggregated data that can no longer be linked back to you.

How we handle your data is spelled out in our Privacy Policy. See §§ 4 & 5 of the Privacy Policy for the specifics on how we use and share data.

8 · Our intellectual property

PostureVision is wholly owned by PostureVision, Inc. The software, computer-vision models, training data and weights, brand, name, logo, crown mark, scoring system (Poise, Mirror Mode, ROM, Daily Check, Self-Corrections, Active Mode, Activations, and any other module we launch), written content, visual design, and the interactions between these components are all our intellectual property or are licensed to us. Nothing in these Terms transfers any ownership to you.

We grant you a personal, non-exclusive, non-transferable, revocable license to use PostureVision for your own wellness — subject to these Terms, and only while your account is in good standing. That's the entire license. No other rights are granted to you by implication, estoppel, or otherwise.

9 · Third-party services

PostureVision relies on a small set of trusted providers for billing, email, hosting, analytics, and distribution. Their terms apply alongside ours when you use features that depend on them.

We maintain the current list of providers — and how each one handles your data — in our Privacy Policy. That's the single source of truth, so if we add, remove, or change a provider, you'll always see the update in one place. We select providers carefully and hold them to contractual privacy and security standards, but we're not responsible for how they operate their own services.

10 · Disclaimers

Important · Wellness, not medical

PostureVision is a wellness tool. It is not a medical device, a diagnosis, or a substitute for care from a licensed clinician. If you have real symptoms, please see a real professional.

Wellness, not medical. PostureVision is designed for awareness and habit-building, not to diagnose, treat, cure, mitigate, or prevent any disease or condition. We are not your doctor, chiropractor, physical therapist, or any other licensed clinician.

No guarantee of results. Posture, pain, and wellness are shaped by many factors beyond any app. We can't promise specific outcomes, and individual results will vary.

Red-flag symptoms. Some symptoms indicate a medical issue that needs evaluation by a licensed clinician — not a wellness app. If you experience any of the following, please stop using PostureVision for now and see a doctor or urgent-care provider:

This list isn't exhaustive — trust your judgment. When in doubt, see a clinician first. PostureVision will still be here afterward, and your sessions will be more useful once you know what you're working with.

"As is." Except where prohibited by law, PostureVision is provided "as is" and "as available," without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement.

11 · Limitation of liability

To the fullest extent permitted by law, PostureVision, Inc. is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost time, or personal injury — arising from your use of the service. This applies even where we knew or reasonably should have known that such damages were possible.

In plain English: if something about the service causes a downstream loss (missed work, a subscription renewing while you were away, a spike in discomfort that made something else harder), our legal responsibility for those downstream effects is limited — even if you'd mentioned the concern to us ahead of time. This isn't us waving away care or good faith; it's a standard software-terms clause that exists because software can't fully predict every consequence of how people use it. We still want to hear when something goes wrong. We just can't promise unlimited responsibility for everything downstream of it.

Our total liability to you for all claims, in aggregate, is capped at the greater of $100 USD or the amount you paid PostureVision in the 12 months before the event giving rise to the claim.

Some jurisdictions don't allow these limits, so some of this may not apply to you. Where a limit isn't permitted by law, our liability is limited to the smallest amount the law allows.

12 · Indemnification

You agree to defend, indemnify, and hold harmless PostureVision, Inc., its officers, employees, and contractors from any claim, loss, or cost (including reasonable attorneys' fees) arising from: (a) your misuse of the service, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, or (d) content or data you submit to PostureVision that you didn't have the right to submit.

13 · Dispute resolution

Important · Arbitration

Most disputes can be sorted out by email. If they can't, we both agree to binding arbitration in Florida — not a jury trial or a class action. You can opt out within 30 days of first accepting these Terms.

Let's talk first. If you have a dispute with PostureVision, please email legal@posture.vision with a short description of the issue and what you'd like us to do. We'll try in good faith to resolve it for 60 days before anyone files a formal claim. Most things get fixed here.

Binding arbitration. If we can't resolve the dispute informally, you and PostureVision agree that any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration is less formal than court, and decisions are final.

Venue and governing law. Arbitration will take place in Lee County, Florida, or remotely if the arbitrator allows. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

Class action waiver. You and PostureVision agree to bring claims only in an individual capacity, and not as part of a class, collective, or representative action. If a court finds this waiver unenforceable, the dispute will proceed in court instead of arbitration.

30-day opt-out. You can opt out of the arbitration agreement and class action waiver within 30 days of first accepting these Terms by emailing legal@posture.vision with "Arbitration Opt-Out" in the subject line and your account email in the body. Opting out won't affect any other part of these Terms.

Exceptions. Nothing above prevents either party from seeking injunctive relief in court for intellectual-property infringement, or from filing a small-claims action where eligible.

14 · Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll email you at least 14 days before the changes take effect, and we'll show you a fresh acceptance prompt the next time you open the app.

Non-material changes (wording clarifications, typo fixes) will be reflected in the "Last updated" date at the top of this page. Continuing to use PostureVision after a change means you accept the revised Terms. If you disagree, you can cancel and delete your account at any time.

15 · Termination

By you. You can stop using PostureVision and delete your account at any time — see Privacy Policy §8 for the process. Deletion cancels your subscription and purges your data within 30 days (except where we're required to retain billing records).

By us. We may suspend or terminate your access if you materially breach these Terms — for example, abusing the service, submitting someone else's camera feed without consent, or failing to pay. Where reasonable, we'll give you notice and a chance to fix the issue before terminating.

What survives. Provisions that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and this sentence) survive termination.
